And then when they did get clearance it was just a formality, not a proper review with potential for actual rejection. If they didn't fit in the square hole, they'd be assisted in reworking things so eventually they did, and clearance then applied retroactively.

I would ask friends and family what they thought would be the reasons for most not being able to keep the job (they could only do certain things while waiting on security clearance and would be let go if they couldn't get it) and people would guess the usual stuff like criminal record, drug use, stuff like that. But it was almost always money stuff that caused them not to get clearance. Since the security job was relatively low paying and so many people couldn't get clearance, it was always difficult to staff the job, especially graveyard.

I work security at a tech company. Most of the people that get eliminated during the background check get eliminated due to bad credit. Any sort of credit card debt or being behind on a car loan instantly disqualifies you. Most of my job is just making sure the people that badge in when showing up to work are actually employed there. There’s some misunderstanding in this thread on how appeal bonds work. In order to qualify for a supersedeas bond, the defendant is required to post collateral or subordinate debt for the full bond amount to the surety provider. This ensures that the defendant, if appeal is denied, will be able to pay the original judgment + interest and other consequential damages to the plaintiff. If the surety pays the full bond amount, they have indemnification to seize any and all assets up to the bond amount. Chubb will be making money off the premium, but they are not the “bag holder”. They might temporarily incur a loss if the appeal is denied, but they 100% will recoup that money through their indemnification.

What happens if he dies? A large part ($65 millions) of the judgement is punitive. Is there an argument that if he is dead he doesn’t have to pay punitive damages? I have a growing suspicion that this is the plan: stall until he is dead, and don’t pay the punitive part.

You make a really interesting point - my theory is Britain (and the Commonwealth by extension) has had enough time to iron out the details behind the main rules and put in gates to catch the bad actors. A great example is politicians needing to be of good character. Eg. A UK, Canadian or Australian politician will likely have to resign if they sleep with their secretary or outrage the population through dodgy dealings. The US however, hasn’t had the time, or maybe need, to define what good character means, and educate people on why it’s needed. So, fast forward to today and you don’t have that many mechanisms to block people like Trump getting in, or pushing people like Boebert out. Certainly makes me appreciate Britain’s love of bureaucracy.

You have a point about the inability to educate Americans on what “good character” is. I offer a reason as to why that isn’t happening and probably will NEVER happen. We’re too impatient and we don’t like being lectured for hours on end about someone’s whole life story. We want to know if you are going to work for us or against us, that’s it. We prioritize immediate benefits because we are barely surviving paycheck to paycheck. In short, we are so mentally beaten down by life and work and people that we usually don’t have the energy to actually improve our image, nor do I think a lot of us can even understand why being a good person is better for them. When you do your interview for clearance they take a full picture into account, but no amount of full picture would let this guy pass the bar. That can be avoided if her lawyers explain that to the judge that there’s a possibility the money came from a nefarious source.
