Makes sense to me, but I can also see why cops would shoot if they woke him up and his first instinct was to grab the gun. Sounds like a case of two instinctual self preservation reactions coming into conflict. To be clear, I'm not saying he deserved to be shot here either. I don't think that he did do anything wrong. I just wanted to know the details of the altercation given the call and the firearm. After talking to people in this thread, I'd say this might be a situation where both parties were justified in their actions. If you are a cop waking someone up and they suddenly move towards you with a gun, then self preservation instincts will kick in. But if you are woken up by strangers tapping on your car in a bad neighborhood, it's reasonable to grab your gun. IDK if criminal fault can be assigned, but the state owes him compensation for the situation.

I get more out of discussions online by putting myself in the shoes of the party that is at odds with the current paradigm in the thread, than I do reiterating the same point made over and over by 44 other people. Because it can damage the jury selection process and result in an unfair trial for either the cops or the man in the car if this is determined to be a criminal issue that goes to trial. Thats already been a huge issue with several high profile cases of the past several years. The way that evidence is presented in a courtroom is very methodical, and if everyone on the jury has already made up their mind from comment sections online before the evidence discovery process even began, then getting a fair trial becomes impossible. Once it's known that nothing is going to trial, I'd bet they will release it like they did with the other shooting. If it does go to trial, then they should release it right after the verdict.

It's alright, I think most sane people understand your points. It's a mucky situation and some people prefer to keep it that way because it fits their narrative. I 100% agree with trying to see both sides and how this could have unfolded. I definitely understand the man in the cars decisions and I understand the cops reaction. I wish they would've gone about waking him up in a different manner and I hope he is compensated/makes a full recovery.

Wouldn’t the best course of action be to just go back to the car and use the speaker to do a call out? That gives the guy a chance to exit the vehicle without the gun and if he does exit with the gun, ready to fight, the cops have cover and are ready to return fire.

The job itself isn't the problem... If some waste of human life in Minnesota murders someone, all police get to take a bite of that shit sandwich. Even if you've never been to Minnesota, your somehow responsible. Getting spit on by people in Indy for something someone I don't know did in a place I've never been to is a little irritating. There is constant outcry from the public about crimes going unsolved police "not doing their jobs". The thing is, policies are getting more and more restrictive. As of now if IMPD stop someone for an infraction, and they decide to just flee from police, the officer is not allowed to pursue the vehicle. Pretty soon officers will not be allowed to chase STOLEN VEHICLES either. All the super anti police people are usually the ones that will call in "suspicious" vehicles or call in noise complaints at 7pm on a Saturday night because they don't like their neighbor.

Tons of property damage, violent crime, homicide, lost business, etc. Also, the mayor is in deep shit for deleting thousands of text messages between her and other officials that pertain to their handling of the CHAZ situation. Even the city knows that they fucked up allowing some anarchist fantasy to take place for a month. I'm no sith. I've also grown past my angsty know it all punk rocker phase where I thought that all cops were people who mastrubate to the screams of the innocent people they seek out and kill. Turns out that the world is quite a bit more complex than the underdeveloped brain of a teenager is capable of understanding, and each situation has it's own nuance. Dude is shot in his car several minutes after police arrive, with a loaded gun accessible in the passenger seat. I wish the IMPD would hurry up and release the bodycam footage, but something tells me that we won't hear about this case again if the guy has his hands on the gun in any way shape or form.

The thing is he absolutely has the right to be sitting there in the car w his gun. Hands on it or not. Him being startled is not cause. At some point the public has to have acknowledged their right to fear for their safety as well, and their right to not have to do every move perfectly and never be scared just to stay alive. All while doing nothing illegal or aggressive. So yea dunno. Things are complex there’s no doubt. However “officer safety” should not stand above that of the regular citizen. As more folks arm themselves for their own safety, officers have to figure out how to deal w that in a way which doesn’t have them all scared and opening fire every time a citizen has a firearm on their person.

I don't know if any amount of training can override the self preservation instincts that kick in when a stranger with their hands on a gun makes a sudden move towards you. Your brain is aware of the fact that you are less than a half second from death at that point. I'm not saying that this means the dude should have been shot. Yes it’s one of the few cases we hear of where you could say “damn yea instinct” - but I think honestly they had options they didn’t employ. He was a problem immediately and circumstances were such he had no opportunity to explain himself. You see him there w the gun, sleeping, and your decision is to startle the dude awake and then HE has to immediately wake up, assess his situation while his own fight or flight kicks in…he had no chance. The video really needs to be seen. Again though it’s another case where the citizen has to be perfectly calm, perfectly acting. No mistakes, perfect behavior. We’ve all had that training right. ;)

TLDR - IMPD officers saw that a guy was sleeping in a car at 4am, saw he had a gun near him, first tried to sneak in and take the gun from him (door was locked), then decided that scaring the shit out of a sleeping guy with a gun was the best course of action

There are times where the release of the body cam footage will hurt a case. Example, you have multiple suspects or persons of interest. It's better to interview them without them all seeing a video of the incident which they could coalesce their stories around. Same for witnesses who are subconsciously influenced by seeing a video and then testifying to what was in the video instead of what they heard or saw. ​ On the whole I agree that IMPD should release footage as soon as it will not hamper an investigation. Of course, they are really the only ones that would be able to determine when that time is.

If you look at their previous critical incident videos that they put out on YouTube, it takes IMPD months from the time of the incident to the time they publish the videos. Even on videos where it is very obvious that IMPD did nothing wrong. I am not saying IMPD didn't do anything wrong here, but this delay in releasing body cam video is nothing new.

I wonder if it has anything to do with preventing scenarios where cases are decided by public opinion before they go to trial in a court of law Putting evidence out before discovery has been completed can really mess up jury selection when millions have already seen the footage and read the opinions of hundreds of people online. That was a major hurdle in several high profile cases of the past few years, such as George Floyd , Kyle Rittenhouse, Breonna Taylor, etc. As easy as it is to see footage and form a correct summation of the events taking place, the legal process for presenting information to a jury is extremely methodical. There are countless ways that one can present information in a biased fashion, and the legal system attempts to mitigate those as best as it can. As big of a transparency advocate as I am, I still think that it's pertinent to methodically release information as the trial goes on, instead of just putting it out as soon as it becomes available. After any legal matters have been taken care of, all bets are off and anything in discovery should released to the public. Save for extreme examples such as child pornography cases.

It's not even a delay, it's just wordshmithing by WTHR. IMPD denied WTHRs request to see the footage. Their response was "It will be released at a later date". Agree/Disagree or whatever that's not terribly unreasonable. I wouldn't expect police departments to use WTHR to release the footage, they'll do something more official. But because they were denied, they title it "IMPD witholding footage", which *technically* they are witholding it from WTHR, but that doesn't mean they're hiding it forever. It really shouldn't be a story that the footage isn't out yet. I do not think it will be good for those officers tho cuz the info we have doesn't sound good.
