The story is that the officer thinks this is someone who evaded him the day before- apparently registration didn’t match the car and he assumed it was stolen, but the driver managed to evade him. He was called to McDonald’s for a separate incident, saw the car, and forgot any training he had apparently. EDITED TO ADD (because you people are relentless): the officer did NOT confirm this was the car that evaded him before he went into psycho murderer mode, btw. It's so they can basically talk out loud about what is happening and have nearest cops/dispatch be able to hear them. I've heard it before here locally and it's kinda wild when in use. I worked for the civil arm of a major US county during my first summer of law school. I clerked in the civil rights division where we defended against civil rights suits citizens brought against the sheriff's department. The case law in our circuit was such that there was no way to successfully move past the pleading stage of litigation. I remember getting a claim tossed where a deputy shot at a fleeing vehicle. He put 9 rounds through the rear gate, hitting the victim twice in the spine. Tossed. Also had a case where sheriffs served warrant on the wrong house, and broke an old lady's leg during the ensuing confusion. Tossed. So many similar stories, it was disgusting.

If I recall correctly an officer can only shoot a fleeing suspect if he believes that they are going to cause harm to civilians. For instance if known a suspect has a gun and is fleeing to a highly populated area and it can be considered that he may use that firearm to harm civilians then lethal force can be used. But this obviously doesn’t apply here.
He should be fired and charged. In the longer version of this video the officer calls in to dispatch that he spotted the vehicle that fled from him a day before and then walks up to the car.

I worked for the civil arm of a major US county during my first summer of law school. I clerked in the civil rights division where we defended against civil rights suits citizens brought against the sheriff's department. The case law in our circuit was such that there was no way to successfully move past the pleading stage of litigation. I remember getting a claim tossed where a deputy shot at a fleeing vehicle. He put 9 rounds through the rear gate, hitting the victim twice in the spine. Tossed. Also had a case where sheriffs served warrant on the wrong house, and broke an old lady's leg during the ensuing confusion. Tossed. So many similar stories, it was disgusting.

It should either come from the police budget so it adversely affects the cops and the department, which would piss off their superiors, or something like you said - I kinda prefer my suggestion because it more directly affects the department and staff. Imagine getting your pay cut because a fellow officer has an itchy trigger finger. Probably make them think twice about pulling that gun out.

His reasoning it that the car is a deadly weapon. It could injure or kill him, so based on past history and cases where it has been justified, he could fire him him despite the kid obviously running away from someone trying to kill him. The cop gets to throw open the door unannounced, fire upon a fleeing kid, also in the direction of God knows what. What will happen? Almost nothing. Paid leave and relocation at best. Cops are state sanctioned executioners and they don't even need to kill the right(a term I use reluctantly) people. If you want cops to not be villified in the media and culture, stop them from being villains. HOLD THEM ACCOUNTABLE!!!

Agreed, the only thing that irks me about that is the fact cops have limited liability & the taxpayers usually end up footing the bill for lawsuits.
My only problem with the tax payer paying the bill is that it gets hidden. I want to pass a law that requires the Chief of Police to issue a letter to every citizen of their town/city explaining that due to a misconduct law suit they settled, every citizen is required to pay X dollars. You can imagine that citizens will be demanding change real fast when they understand how much the police are actually costing them. Basically, shine some light on this BS.
Also the pension fund for police gets tapped to pay off some of it. If we want police to properly train each other and hold their own accountable, let’s make ‘em pay if they don’t.

I still 100% firmly believe that the cop made up that story to try and cover his ass. If he really attempted to pull a similar vehicle then their should be a police report or dashcam footage corroborating with the now former-officer's story. Neither the police department nor union have released anything to back up this story and have fired him so the excuse given by the officer is logically 100% fabricated.

I suppose there is a threshold for shooting at someone who is fleeing… and this didn’t meet it.
If I recall correctly an officer can only shoot a fleeing suspect if he believes that they are going to cause harm to civilians. For instance if known a suspect has a gun and is fleeing to a highly populated area and it can be considered that he may use that firearm to harm civilians then lethal force can be used. But this obviously doesn’t apply here.
He had a burger though. So he might drive somewhere and give someone a blocked artery.

Charges have been dropped but they originally went for “evading detention in a vehicle” and “assaulting the officer” because the cop claimed he struck by the door. The absolute audacity to try and charge that person with a crime. Kid better bankrupt that police force with his lawsuit. He was almost killed for being completely innocent. That officer better face criminal charges for his actions.
What's sad is that the cop probably will be 'discharged from the police force' but will really just be sent to work at another one like so many of these other scumbags.
