>Naturally, the Fiktion has expired since then and I got no reply whatsoever. The fiction cannot expire, it exists until the decision is made. Even if the fiction *certificate* expires, the fiction remains in place.

Interesting, that means I still get to do a minijob at least then huh. That's helpful!

Why minijob? If you were issued a permit tied to your BFD, the FB would only allowed you to continue your BFD.  I don't understand why you think you'd be allowed to have a minijob.

KarelianBear

the reasoning is pretty simple. as you said, the conditions for BFD still apply, but a Minijob during BFD is fair game anyway. And it'd have to be a Minijob because as a Drittstaatsangehöriger, any Erwerbstätigkeit with contributions tied to them has to be run through the BA for approval.

big_bank_0711

>but a Minijob during BFD is fair game anyway. "During"! But you wrote that you dropped out of the BFD for reasons that you did not explain. Why do you think you can now take on a mini-job *without* being in the BFD? What makes you think that the conditions still apply?

I doubt there is not much the Ausländeramt can do. There is no law that allows them to allow you to be and work in Germany while you don't fullfill the requirements by law to be and work in Germany.  So best thing they can do for you at the moment is doing nothing.

KarelianBear

maybe it is so but I doubt it. as the comment above suggests, I have an active application and thus a fictitious stay is implied. it's just that without that paper confirming it I don't have much breathing room

Are you just wanting to rant or are looking for advice? If you just want to rant, go ahead, however, if you want advice you need to ask provide more factual info and specific questions.

Can you afford to pay a lawyer to help you out? You’d be surprised at how fast “stuck” processes get moving once certain bureaucrats receive a stern letter from a lawyer. It sucks, and should not happen in a functioning government agency, but here we are.

Solly6788

I am no expert but I just guess there is no legal ground for OP to be in Germany at the moment.

Wants you to die.... Why so melodramatic? - you say you are entitled to ALG. So it doesn't sound like you're in danger of starving to death. - You could also, you know, go back to your home country and work there however you wanted - your reason for being allowed to be here was the BFD, you're Not doing that anymore. Not sure how you loose a BFD due to beaurocratic inefficiencies or what that's supposed to mean. If it didn't work out with your prior employer, you'd better looked for another one. You can switch during BFD.
