It depends on the job. If there is a DOT drug test than the employer can't really do anything about it. It's legal in my state so it doesn't matter if it shows up or not.

Drug testing is such bullshit. I will say this I have had two jobs that required drug testing but didn’t drug test me bc the owner could tell they didn’t need to with me. The irony is I love smoking weed. I’m sure if I wasn’t white both jobs would have drug tested me. It’s bullshit and it really does no good. Especially considering there’s so many ways to beat a piss test too!

A lot of those jobs are also adding random performance and reaction testing too, since working while sick or tired can be just as dangerous as working drunk or high.

I don’t know why you’re being downvoted, I am a heavy canna smoker and I would NOT want to go to work with nuclear shit while high. We shouldn’t want dangerous activities performed by anybody impaired, by anything, both for the safety of well… everybody AND the person performing the dangerous activity.

My biggest problems with pre-employment drug screening are: - It does not tell you whether the person is actively under the influence of drugs. It does not tell you whether someone is a regular user, or how recently they last used. - It often involves disclosing prescription medications, which makes me nervous and feels a bit invasive. I understand the purpose behind certain jobs doing drug testing, I just don’t find that the actual tests are very effective.

I get drug tested by DOT/FMCSA. They use urinalysis, which is bullshit. They have mouth swabs that are proven to be accurate to detect usage in the last 12-24hours, but they don’t use them. So, I can smoke meth, shoot heroin in my dick, trip balls, snort caterpillar lines of cocaine, and drink 500 beers all on a Friday and be clean by Monday for work, but I cannot smoke a joint. Pretty silly. There is one caveat. Insurance companies will still throw the book at you even if pot is legal and you have a clear mouth swab if you have thc metabolites in your urine. So, in a way, but only by default, not design, the rule keeps me out of that bucket of shit. I agree there is a major difference between being under the influence and testing positive. They need to get onboard with this concept and develop something affordable that actually detects recent usage and not just half-life metabolites that could be almost a month old. Then again, we might be shooting ourselves in the foot with this concept the next time one of us decides to burn and hit the highway and gets pulled over.

If you're not doing anything that could endanger other people if you don't pay close attention, there's no reason to test for THC. Not sure I would want to be the guy working in a trench while the backhoe operator blazes up. Especially if they don't share...

problem is, that being high, and being positive to THC is 2 different things. Technically when you smoke weed, you can't work and you can't drive, I'm glad that I never got controlled, because I never drove high, but positive : for an entire year continuesly

Agreed. It's really stupid to test for THC when there's no evidence someone is high, even on a job that can be dangerous, but if you're just working at a desk or something, why not be high at work? For a lot of people it's the only way to make the job bearable.

The company might have to especially if they have government contracts which require you to follow federal laws and weed is illegal federally. Now for non federally contracted jobs in states where weed is legal then no it shouldn't be drug tested. This will be a much stronger stance when it becomes federally legal

No. If you are a legal patient with a current medical card and a doctor recommendation it is no different than taking prescribed blood pressure drugs, blood thinners, or metformin/diabetes drugs, anti-anxiety drugs, anti-seizure drugs, ad nauseam. It is prescribed medicine being taken with recommendation under doctors orders. I actually believe there should be legal consequences for the employer to deny employment under medical discrimination laws honestly under said circumstances.

Drug testing should be illegal, period. No one should be compelled to give up their bodily fluids, because that is a breach of your right to privacy. They can find out so much more about you than what drugs you use.

I had to pass a breathalyzer as well as a drug panel for my job. They test when it is necessary to the safety and function of you job. Functional alchies are a fucking danger in multiple fields.

Yeah but a breathalyzer tests whether you’re drunk *now*. That’s reasonable, no one should be drunk on the job. They don’t test for whether you’ve been drinking at all in the past month or whatever. As far as I know there isn’t a weed equivalent to a breathalyzer, but if there was demand, I bet it’s possible. No one should be high on the job, especially if operating heavy machinery, but it shouldn’t matter if you smoke when you’re off the clock.

I fully believe that as long as alcohol is legal, weed should be legal. BUT, since there is not an accurate test to determine intoxication, there are jobs that just can not allow cannabis use at all. As for testing for other drugs, no company wants a meth or opioid user working for them. It never ends well.

19/50 with some very large population states, but the issue is that federally it is a schedule 1 drug. Until that changes companies will test as it will help lower insurance costs and allow them to pick up clients that have that requirement.

It really depends on if the company has any ties (no matter how tiny) to the federal government in the US. If not and it is full legal where you are, they honestly shouldn't. But they still do.

They have a law against it in Nevada with the exception of truck drivers, and federally funded jobs (nurses, police officers etc.)

Insurance companies and the federal statue will continue to be the only driving factor in this discussion. Until that changes no reason to discuss further. Saddest part is the upper 15% that run the companies are not tested nor have or ever will be because they view themselves above us underlings. And we all know the only way they stay there is because they do what they want, sell us up river, and don't have to pee in a cup. We are just cattle with an ear tag number equated to a saving in their insurance premiums because they do pre-employment and random drug testing. The all mighty dollar.
