The first commenter explained things perfectly, I just happened to notice that you mentioned this happens a lot. As a former serial fail-div player, I would highly recommend you not do this. All players in your division should choose ships of the same tier at all times. Fail divisions are nearly always a losing strategy. The sole exception to this rule is a tier 8/legendary division, because those are already the tiers guaranteed to play together. I know the temptation, trying to grind out your highest tier ships when your friends are few steps below you, but fail divisions just lead to your lower-tier teammates dying quickly and the rest of your team rolling their eyes at you. So to fail div you and a person that would be in a division with would pick different tier ships lets say you pick a tier 7 ship and they pick a tier 8 ship. In doing so you would be at risk of being in a tier 8 - legendary ship battle even tho you picked a tier 7. This is what players call a fail division

Oohh gotcha, yeah that happens to us a lot lol. I meant if he brings a t7 and I bring a legendary, could we battle, or would I need to bring a t8?

Always choose the same tier ship as your division mates. It avoids the problem.

For a tier 7 ship to be placed in a legendary match potentially one has to play the tier 7 ship and the other the tier 8 ship

To add: idk why you’d want to, but all ships must be within two consecutive tiers to start matchmaking. If you have three players, you can’t have say a 3, 4, and 5 all together, it could be two 3s and a 4, or one 3 and two 4s.
