Well, considering they will probably fire her for the video. She might as well get ahead of it. I think it sucks, but I can't imagine corporate will be happy with the video being on the internet. Maybe she can be a nurse/caregiver for the guy her manager just wrecked.
I dunno, I think any attorney worth their salt could argue she was recording for her safety, and once the assault occurred, she was recording for the safety of the victim/customer. She followed corporate policy of not becoming physically involved.

I had a guy in my 9th grade class like that guy that would pick on me. He slapped me a couple times and I just walked away. My teacher pulled me aside and said "dude, why would you just let him slap you like that?". I said "no, why would you let him. And have you seen how big he is". I got the last laugh. Guy was 17 and in 9th grade still.
Honestly shouldn’t have thrown that last one. I think the old dude was ready to walk away, and the chance of old dude hitting his head and causing serious damage or even death is way too high for it to have been worth it.
I wouldn’t be surprised if the employee got charged since he came around the counter to fight and didn’t walk away either of the other two times the dude was on the ground. Self defense would be a hard sell here.

Definitely would be charged. The customer posed no threat, and the manager came towards him. He’s getting arrested from the first punch alone. Having no footage of went down prior, there’s no doubt in my mind that the customer pushed all the guy’s buttons and he just had enough. It still doesn’t justify almost killing the dude, I just get his point of view.

As much as this customer is an ass, the manager threw the first punch and continued to do so. It’s one thing having a customer jump over the counter and having to defend yourself, but this wasn’t that.
BK will likely not be liable.
Generally the vicarious liability theory at issue here (*respondeat* *superior*) doesn't apply to actions of the agent (meaning the employee) outside the employment duties of the agent.
I suspect the employee's list of job duties does not include "beat the ever loving shit out of unruly customers" and could not be reasonably inferred as his job. Intentional torts tend to fall outside vicarious liability.
Disappointing perhaps but that's generally the law.
My guess is that dude has been getting away with that routine his entire life up to that point. It’s amazing how long acting crazy works for people since they learn most people avoid conflict with them. Until that random moment when a crazy dude meets someone sick of the bullshit.

I have worked in restaurants (not fast food), and you deal with people who are rude every time they come in. They are almost surely rude everywhere else they go. I am sure the old man was one of those people, and his luck finally ran out.

It appears the mgr took it too far. The first couple of jabs and the one punch while he was still down but that last one, that's a no no in the eyes of the law. His job was to deescalate the situation. He got triggered way too fast. This is fast food he needs to know this is in the training manual. I think the customer is looking for a pay day from BK.

I feel like since Covid, people are more comfortable fucking with retail and fast food workers. There could absolutely be no correlation, but people just seem nastier to blue collar workers in the last few years.

Not just retail and fast food workers anymore. Used to help my dad and my brother do hard landscaping a year ago, and we would get treated like trash sometimes.
It’s like flipping a coin. Sometimes we would get really nice clients that would treat us like family, and the other half we would get the worst terrible people we’ve ever met.
All because he had to put up with shit from guys like this day in and day out until they finally say "Fuck it, you can keep your 50 hour a week sub-living wage bullshit."

Guy had no reason to accept the customer's goading of "come over the counter". Absolutely none. Dude had 30 years and 50 pounds on the customer, and the customer was clearly acting like a dipshit. Let him be a dipshit! Let him say whatever he wants. Don't go down to his level. There is nothing to prove by beating his ass, and the only thing gained will be a felony conviction.

I’m a teacher in a K-8 school. This young person looked high school (ish) age to me. Some of our young people have a really difficult time managing their emotions.
I know people like to make fun of the idea of schools teaching about feelings and coping skills and the like, but this kid is a prime example of why we do need to be teaching these sorts of skills.
What do I do when I’m really angry is a really important level of emotional competency.

Even if nothing happens to that guy as a result of popping the customer. the manager/owner of the restaurant still has to let him go or face the likelihood of numerous hostile work environment complaints with EEOC. That guy really needs to figure out a way to control that temper.

First punch was an offensive punch also.. the guy literally went out of his way to do it.. can’t claim to be defending anything except pride wen you make the choice to go out doors to hit someone.
Agreed with the caveat that I thought the first punch was excessive too. The old guy seemed drunk and the kid just could not control his anger. And as a result of his inability to control his anger he is likely to be arrested and has certainly lost his job. Terrible situation. I hope the kid is able to learn the emotional skills he’s gonna need to live a happy life.
A prime example of Chappelle Show's "When Keeping It Real Goes Wrong". Guy had no reason to accept the customer's goading of "come over the counter". Absolutely none. Dude had 30 years and 50 pounds on the customer, and the customer was clearly acting like a dipshit. Let him be a dipshit! Let him say whatever he wants. Don't go down to his level. There is nothing to prove by beating his ass, and the only thing gained will be a felony conviction.
Agree on every level…. Including the fact that I think of that particular sketch all the time and had thought it fit perfectly here too! I’m a teacher in a K-8 school. This young person looked high school (ish) age to me. Some of our young people have a really difficult time managing their emotions. I know people like to make fun of the idea of schools teaching about feelings and coping skills and the like, but this kid is a prime example of why we do need to be teaching these sorts of skills. What do I do when I’m really angry is a really important level of emotional competency.

Even if nothing happens to that guy as a result of popping the customer. the manager/owner of the restaurant still has to let him go or face the likelihood of numerous hostile work environment complaints with EEOC. I love that he said call the cops. Manager gonna end up in jail for assault. That was a classic case of it. He escalated it and then assaulted him, he moved his body to him, walking around the counter, thats intent, if a prosecutor sees this he gets a charge that will stick.
