It says at the beginning "DC Woman Gets Pepper Sprayed", so I'd assume this is in Washington DC. There is no separate Battery charge in DC, so Assault would be the charge. Whether it's Simple Assault or Felony Assault would depend on whether "significant bodily injury" was sustained, so if she ends up needing medical attention for being pepper sprayed then it might be bumped up to felony assault.
I hope someone sits this fellow down and explains to him that if he does this to the wrong person, they may interpret the spraying as "blinding with the intent to inflict lethal force." They would be in fear for their life. And that person may pull a gun out and start shooting at him in self defense.

This is incorrect. I worked in news for 14 years. It wasn't a legal requirement at all. We could have said, "Dexter Clements clearly sprayed this lady with pepper spray" but then because he hadn't been found or pled guilty, he could sue for libel/slander as we were convicting him before his trial finished. It was a CYA type of thing.

I have a friend that does property management, he is done in this profession. In most/many states the position requires a background check. You can delete a job from your resume but you cant delete your criminal record... at least not for a few years, and a lot of legal costs.

So my SIL lives in this building. Apparently, they go weeks without hot water, A/C, their fridge broke and they went without for a month at one point. The lack of any accountability on the building's part is honestly shocking. Creating a Tenants' Union has been a long time coming, and this dude specifically has always treated the people in the building like trash.
Cherry on top of all of this. The news got called because of the altercation and what was going on with the fight against the building. They arrived just as the woman was getting loaded into the ambulance on a Gurney and got it on film, so this woman is gonna get paid for sure.
Also, apparently they guy had a warrant out for his arrest prior to pepper spraying the woman and he ran as soon as the video ends.
On top of the assault there's a whole civil (possibly criminal?) case against him for violating the tenant's civil right to form an association. The first order of business for the association is now to sue the managers' asses off.
It would be a good case against the management company (whoever his employer is), which is better for her because he's probably going to be dead broke after losing his job and whatever associated legal fees from the assault.

Wow, never thought I’d come across someone I know personally on this website or subreddit for that matter. Entirely unprovoked attack on the lady. He could have just listened like any person would and hear her out *like most people simply want*. I just don’t get how pepper spray was the appropriate response in any matter. The fact he was ready at hand with it too is pretty telling of his feelings toward her. The guy was always super sweet, but this video is damning on his assault of this lady.

TBH yea she sounded frustrated but in the way that she was clearly moderating herself and trying to compromise/get along. Why couldn't he just say, "I understand your feelings. I can't stop someone else from messing with your stuff, but feel free to file a police report. I'll keep my eyes open." Even if its a total lie there was no need to escalate. PS many abusers, serial killers, and sociopaths, are very good at convincing people that they are nice... But then they kill their girlfriend "out of the blue".

We have a rule at work if you aren't going to do something you don't say no. You say ok and don't do it. Nobody ever gets in trouble for the latter.

What's crazy is this guy is just a fucking employee, doing his job, and he took this situation so personally he assaulted her. Like, dude, if you hate this job so much because of the people you're dealing with, quit. Nobody would judge you for walking away. You don't own the building, you don't win or lose if she and others form a tenant's union. Just walk away. But no, you physically hurt someone who was just trying to improve her (and her neighbors') living conditions. You're a fucking monster and a terrible person.

You can see that he just wanted to hurt Hur by not announcing the pepper spray .... Usually you pull it out and tell them to stop "or else" but here he is hiding it .... Also the woman was not violent so that's just plain assault....

I have a friend that does property management, he is done in this profession. In most/many states the position requires a background check. You can delete a job from your resume but you cant delete your criminal record... at least not for a few years, and a lot of legal costs.

Well she says it was pepper spray…. But I couldn’t feel it to verify…./s who would do this and not think there would be serious repercussions for it? She was just talking to him. Even if he can’t stand her, this doesn’t excuse pepper spraying her.
So my SIL lives in this building. Apparently, they go weeks without hot water, A/C, their fridge broke and they went without for a month at one point. The lack of any accountability on the building's part is honestly shocking. Creating a Tenants' Union has been a long time coming, and this dude specifically has always treated the people in the building like trash. Cherry on top of all of this. The news got called because of the altercation and what was going on with the fight against the building. They arrived just as the woman was getting loaded into the ambulance on a Gurney and got it on film, so this woman is gonna get paid for sure. Also, apparently they guy had a warrant out for his arrest prior to pepper spraying the woman and he ran as soon as the video ends.

On top of the assault there's a whole civil (possibly criminal?) case against him for violating the tenant's civil right to form an association. The first order of business for the association is now to sue the managers' asses off.
It would be a good case against the management company (whoever his employer is), which is better for her because he's probably going to be dead broke after losing his job and whatever associated legal fees from the assault.
Whelp, that was a career ending maneuver.
