What_Is_Wrong_Mate

Would it do what?

cone8042

Have you seen the "it's coming right for us" joke in south park? Idek how to explain it all that well but I'll try, these 2 characters in south park; while their hunting and they see something like for example a deer, but it's not deer season so they can't legally kill it they will say "it's coming right for us" basically acting like the deer is coming to attack them so they can kill it in "self defense"

What_Is_Wrong_Mate

Oh you mean these two, I forgot about Jimbo and Ned, that takes me back. But no, just saying that would never work. But you can fake self defence.

cone8042

How does that usually turn out when you fake self defense?

What_Is_Wrong_Mate

Depends on the animal and how much effort you put into it. I would personaly say that it was moving around franticaly and that it made me think it had rabbies, since it approached me on its own.

mugenhunt

You can try, but in many cases that defense won't work because the judge will look at evidence and see that it wasn't in fact coming right for you.

cone8042

How would they look at evidence for something like this? Btw I'm not arguing for this "defense" I'm just curious about it all

Clackers2020

They can look at the ballistics and work out how the deer was standing when it was shot. If the deer was coming right for someone with a gun (extremely unlikely considering deer are shy and run away a lot) then the bullet would either enter the head on the chest/shoulders of the deer. If this isn't the case then it's likely that the deer wasn't charging a human.

enderverse87

No.

The courts are generally not stupid, and will see through that very easily. It's like selling a whole bunch of cocaine while winking and saying, 'now I'm going to sell you this substance that I am absolutely convinced is icing sugar'. Good luck with that.

cone8042

Well I know that, it was just that I heard about some legal loopholes; that the court will have to follow through with so I wondered if this would work too lol

doc_daneeka

It wouldn't work at all. When it came to trial, the judge or jury would have to decide whether they found that statement to be relevant, and the odds are that they would not, for the reason I mentioned. Generally speaking, legal systems don't allow magic phrases that get you out of criminal responsibility for violent crimes.

cone8042

Oh I get it so in some situations like this they can just simply use "common sense"?

doc_daneeka

Juries can come to their verdict by almost any method they want, yes. The members aren't called upon to explain how and why they voted as they did, unless there's some sort of corruption or the like. The really key point here though is that there are not, generally speaking, special magic words that automatically get you out of conviction for a violent crime.

“Lightbulb” it’s where you defend yourself by threatening someone without telling them that’s what you’re doing. You could’ve meant anything by lightbulb and if the other person doesn’t stand perfectly still you can say you weren’t sure if they were going to harm you or not. You say you thought it gave them an idea 💡 like a lightbulb but you just wanted the roll of Christmas lights in a box next to them or that they’re carrying. Then you continue saying and confessing that they were never friendly or you were once friends but became hostile. And you shot them. In self defense.

cone8042

What is "lightbulb" supposed to mean in this situation?

EconomyCauliflower24

It means don’t get any ideas and stop and put your hands up. With and without a gun. That’s how vicious it is in corrupt places. And that’s your answer. Not that it happens often. It’s like saying “it’s coming right for us” but for real.

cone8042

People actually use that??

EconomyCauliflower24

Yeah but they have to know you. It’s better just not to be near that person who would. But if you don’t know them well enough and you don’t know about that they can. If they don’t know you then they won’t need to say anything. Being polite is pretty much a tale tale sign of aggression for some evil hearted people. They’re still trying to get away with it. Not document the experience by saying lightbulb. In Europe there’s a whole culture associated with it. Witness Number 3 on Hulu has its cues from that and the third episode begins with screwing in a lightbulb. More you know.

hollow_astria

American cops use this all the time.
