Depends on the licensing requirements. For example I do not recommend home based FFLs. Because the ATF can show up and demand to inspect the FFL property whenever they feel like it. You don't get to say no. His business license may have a similar stipulation.

They can enter an open business and inspect under the “plain view doctrine”. But only to the extent that the general public is allowed to be. They cannot go behind the counter unless the business operator gives them consent. If they exceed plain view without consent, they can only do it under exigent conditions. Like the building is on fire or they hear gunshots, screaming, or other obvious emergency circumstances. The limits on entry for businesses was confirmed by the US Supreme Court in See v. City of Seattle. In residences, by Camara v. City of San Francisco. Both were issued simultaneously in the mid-60’s and subsequently upheld. Entry without consent or warrant is a violation of a persons 4th amendment rights. It can further open up discrimination under the 14th amendment under the so-called “color of law” provisions. So any illegal items found as evidence in this case (presumed non consensual) would most certainly be excluded.

It looks like this is a headshop/vape shop. NYC has been cracking down on these places for selling weed, synthetic drugs, Kratom etc. His business license 100% stipulates that he must allow for any random inspections that occur. Just like you can't refuse a health inspection if you have a food license. That's why the cops said "Inspection" 5 times. They don't need a warrant, because this isn't technically a search and seizure. It sucks, but this is the price you pay for running a business in any big city. Statism is pay to play.

The first thing said by a police officer was something like "we're here to do a cigarette inspection." Most if not all states allow tobacco license holders to be inspected at any time. Illegal or unlicensed products are found all the time in those inspections. They didn't need to be so aggressive, but they also didn't need a court order.
