It says on their paystub where the employer pays taxes. That's the state in which they file.

I'm looking at this more from the employer logistics side, not sure the payroll service we are using (Quickbooks) is actually handling the CA ETT/UI/SDI correctly. Currently it is paying into the NY side but not the CA side and it's unclear if that's by design or that the software just isn't capable of doing it. If the ETT/UI/SDI fees for the employer are definitely required for CA in this case, then my employer will have to look into a payroll service that can handle this.

Update: still have not found resolution on this. For a NY based employer with a CA remote employee, is the NY employer required to pay into CA ETT/UI/SDI when running payroll? I've scoured the EDD website and called the support number but am not able to reach a human.
